Hi,
Bought this phone from Tesco Xmas 2008 for £40. Screen started bleeding in July and within 24 hours it was unusable.
It was my wife's phone and she has used less than £10 credit in 6 months - hardly any usage.
Returned it to TESCO, local store refused to change it, said it needed to be sent off to Tesco Mobile, who sent terse letter & said we had damaged it and they would repair it for £50 !!!!!
PS: BEWARE this is not actually TESCO who do the repairs they have farmed it out to a third party supplier. I found them VERY unhelpful.
They told me Nokia do not even guarantee a phone screen for 24 hours if it's been put in a handbag because that is not normal use. Is this correct ? The Warranty makes no mention of this caveat.
I don't know whether to purse Tesco or Nokia through the small claims court ?
Any advice would be apprecaited.

It doesn't take much to damage a screen, especially on low end models. They aren't built to take knocks and bumps so the simple act of being bounced around in a handbag can damage a phone, this is classed as rough handling which is mentioned in the warranty terms. Sometimes all it takes is a purse full of coins or a bunch of keys to strike the phone in the wrong place.
Even though it is clearly your wife's fault if you do decide to pursue anyone in the courts it will have to be the retailer, not the manufacturer as they are protected by the warranty terms.
Protective cases should be used to prevent damage to future phones that you may purchase.

Hi,
Thanks for your reply & advice.
It is frustrating when you buy something and on the receipt it says "Guaranteed for One Year" but this is not actually the case, even for a reasonable person would call "normal use". It appears that phone manufactuers can supply products that are "not fit for purpose" ie: Don't put it in your pocket or handbag !
The £40 for the phone is not the problem, It's the principle that's up for discussion. £40 -> £400 phone, same principle ? Same "guarantee" ?
I spoke to the TESCO store in questions and asked what happens if I spend £500 on a phone turn it on in the store, put in my pocket, walk to the car and then find the screen is bleeding. They told me this consitutes "rough handling" because it has been put in a pocket. The use of a protective case makes no difference.
I'm checking out the relevant law on "what a resonable person can expect"......
I would love to hear back from other people of how they have been treated by retailers and phone manufacturers when screens bleed.
It would also be nice to find out if anyone has actually had a retailer or Nokia refuse to replace a phone that has developed this type of faulty in less than 24 hours !!! I'll provide a prize for the person who comes up with the shortest time period !
Apparantly [according to the staff in the Tesco] Nokia have a 100% non failure rate on their screens and that any problem of this nature MUST have been through misuse. In no other circumstance whatsoever can screens bleed other than through rough handling.
I've have been using Nokia phones for nearly 15 years and never had a single problem with any until now. In fact most of my old "brick" phones 6200 etc still work perfectly well. As does the spring loaded slider on my 7110 "Matrix" phone.
PS: psychomania - How did you make the judgement it was "clearly your wife's fault" when you know nothing about the usage of the phone or where it's been stored ? Do you work for or on behalf of Nokia ?

Come on, get real everyone knows how phones get bashed about and/or tightly squeezed in handbags, it's naive to think otherwise. Without a case it is clearly asking to be damaged. I have seen this happen with many phones from many manufacturers. Obviously the brick phones of old were better equipped to handle this but things have moved on as people want more compact phones.
The phone in question is not listed as tough phone so you cannot expect it to perform as one.
People will rarely accept responsibility for their actions and often try to shift the blame. It's a way of making themselves feel better after trashing their own phone. It's like the old trick when people try to return a phone that has been dropped down the toilet.
And to answer your question, no I do not work for nokia but I do know the lengths that people will go to just to get a free replacement.
If you feel that tesco has been unfair (or has given incorrect advice) in not accepting any responsibility then you can take the phone to a nokia care point. They will professionally judge it based on the overall condition if it can be repaired under warranty or not.

Hi
Did you get this resolved. It seems to me that it is completely unreasonable to refuse repair because the phone was kept in a handbag!

Hi Radagast,
No progress so far.
It appears that Nokia have "previous form" for not repairing items that have failed whilst being used "normally" [or what a reasonable person would consider normal].
See: /discussions/board/message?board.id=communicators&
I have not been able to get to a Nokia Repair Centre yet but based on the thread above I am not expecting a sensible outcome.
It is useful to air this information though so that others can know what to expect if their phone fails after they "handle it roughly" by putting it in their pocket or handbag. They may wish to adjust their purchasing decisions accordingly.
I might have to buy a decent/more robust phone like a Blackberry.
I will certainly never buy another Nokia for my wife or any of my staff.
Thank you for your interest, will keep you posted.

Hi
I will also be pursuing a claim against Nokia as my daughters 5800 bled into the screen after 3 months with no evidence of rough handling. I think the limitations in the warranty contravene EU legislation and will be taking legal advice. I too will keep you posted
